By accessing or using the Privada mobile application (“App”), you agree to be bound by these Terms of Service (“Agreement”), our Privacy Policy, and all applicable laws. If you do not agree with these Terms, please do not use the App.1. License GrantPrivada grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.2. User AccountsYou are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.You agree to provide accurate and complete information when creating an account and to keep your information reasonably up to date.3. Prohibited ConductYou agree not to:* Post or share illegal, harmful, abusive, harassing, defamatory, obscene, hateful, or discriminatory content.
* Impersonate another person or entity.
* Provide false or misleading information.
* Engage in fraudulent, deceptive, or unlawful activity.
* Upload viruses, malware, or harmful code.
* Violate intellectual property rights, privacy rights, or other legal rights of others.
* Use the App to spam, harass, or intimidate other users.
* Attempt to interfere with the security, operation, or functionality of the App.Privada maintains zero tolerance for abusive behavior. Violations may result in immediate suspension or termination of your account.4. User-Generated ContentYou retain ownership of the content you submit through the App.However, by submitting content, you grant Privada a worldwide, non-exclusive, royalty-free license to use, display, reproduce, distribute, and modify such content solely for the purposes of operating, improving, maintaining, and promoting the App.You are solely responsible for the content you submit and must ensure that it complies with applicable laws and these Terms.5. Vendor Listings and CommunicationsPrivada provides a platform that allows users to discover and contact vendors and service providers.Privada does not guarantee the accuracy, quality, legality, safety, availability, or reliability of any listing, vendor, service, pricing, or information advertised through the App.Any transactions, agreements, communications, phone calls, text messages, payments, bookings, or other interactions between users and vendors are solely between those parties.Privada is not responsible for disputes, cancellations, damages, losses, service quality, payments, or other issues arising from interactions or transactions between users and vendors.6. SMS CommunicationsPrivada may provide users with the option to receive recurring SMS text messages from Privada.If you voluntarily opt in, SMS messages may include:* Account updates
* New features
* Privada service updates
* Promotional offers
* Opportunities to increase your visibility on the platform
* Other information related to PrivadaConsent to receive SMS messages is optional and is not required to create an account, create a listing, purchase a subscription, make a purchase, or otherwise use Privada.Message frequency may vary. Message and data rates may apply.You may opt out of SMS communications at any time by replying STOP.For assistance, reply HELP or contact us at [email protected].After you opt out, you may receive a final SMS message confirming that you have been unsubscribed. You will not receive additional recurring SMS messages unless you choose to opt in again.Wireless carriers are not liable for delayed or undelivered messages.If you change or deactivate the mobile phone number associated with your Privada account, you are responsible for updating your account information.Your consent to receive SMS messages applies only to communications for which you have provided consent.For more information about how we collect, use, share, and protect your information, including your mobile phone number and SMS consent information, please review our Privacy Policy.7. SMS PrivacyPrivada does not sell, rent, or share your mobile phone number, SMS opt-in information, or SMS consent with third parties or affiliates for their marketing or promotional purposes.We may use service providers to help us deliver SMS communications. Information may be provided to those service providers only as necessary to provide communications and related services on our behalf.Additional information regarding our privacy practices is available in our Privacy Policy.8. Content ModerationPrivada reserves the right, but not the obligation, to monitor, review, remove, or restrict content that violates these Terms, our policies, or applicable laws.Users may report violations by contacting:Email: [email protected]9. Account Suspension and TerminationPrivada may suspend, restrict, or terminate your account if:* You violate these Terms.
* Your actions create legal exposure or risk to Privada or other users.
* You engage in abusive, fraudulent, deceptive, or harmful conduct.
* Your use of the App interferes with the operation or security of Privada.10. Age RequirementsYou must be at least 18 years old to create an account or publish listings through the App.By creating an account, you represent that you meet this age requirement.11. Subscription TermsPrivada may offer auto-renewable subscription plans that provide access to premium features.Payment will be charged to your Apple ID account at confirmation of purchase.Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the end of the current period.You can manage or cancel your subscriptions at any time through your App Store account settings after purchase.Any unused portion of a free trial period, if offered, will be forfeited upon purchasing a subscription.Subscription pricing, features, and available plans may change from time to time and will be disclosed within the App before purchase.12. Third-Party Services and LinksPrivada may contain links to, integrate with, or allow users to interact with third-party websites, platforms, payment providers, communication services, or other third-party services.Privada does not control and is not responsible for the availability, content, privacy practices, security, products, or services of third parties.Your use of third-party services may be subject to separate terms and privacy policies provided by those third parties.13. Changes to These TermsWe may update these Terms from time to time.Changes become effective when the updated Terms are posted or otherwise made available through the App.The “Effective Date” at the top of these Terms will be updated when changes are made.Continued use of the App after changes become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.14. Disclaimer of WarrantiesThe App is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.Privada does not warrant that the App will be uninterrupted, error-free, secure, accurate, reliable, or free from viruses or other harmful components.Privada does not endorse or guarantee any vendor, listing, service provider, service, price, availability, or transaction made available through the App.15. Limitation of LiabilityTo the fullest extent permitted by applicable law, Privada shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the App.Privada is not responsible for losses or damages resulting from transactions, communications, agreements, disputes, or interactions between users, vendors, or other third parties using the App.16.
